Jennifer Spaith and her colleagues, Brian Park, Jonathan Barnard, and Nathan Brunette will provide an annual review of recent developments in patent law, including summaries of the high-profile patent cases decided at the Federal Circuit Court of Appeals, along with a discussion of recent developments in the areas of subject-matter eligibility, patentability, and infringement, PTAB practice, and damages.

Jennifer Spaith is a trusted source of intellectual property advice for Stoel’s clients. Jennifer has experience in counseling clients in the acquisition and enforcement of all forms of intellectual property—from patents to copyrights, trademarks, and trade secrets. She assists clients in balancing their approach to their IP portfolios. Jennifer has deep and specific experience with patent prosecution and portfolio management, including the development and analysis of litigation-ready patent assets. Jennifer leverages her technical background to work skillfully in complex electrical and software disciplines and adjacent fields. Jennifer has represented companies of all sizes that develop a range of technologies including virtualized software systems, enterprise software, distributed storage, wireless communication systems, medical devices, imaging systems, artificial intelligence and neural networks, augmented and virtual reality (AR/VR) applications, microfluidics, biosensors, LiDAR systems, and clean or renewable energy technologies, including purification technologies and waste-to-energy systems. Jennifer also frequently advises clients on transactional matters involving technology and intellectual property. Before joining Stoel Rives, Jennifer was an attorney and patent agent with a global AmLaw 100 firm.

Brian C. Park is a litigation partner and current chair of the firm’s Technology and Intellectual Property (IP) group. He has served on the firm’s Executive Committee and Diversity, Equity & Inclusion Committee. For over ten years, Brian has also chaired the Federal Bar Association IP Committee of the U.S. District for the Western District of Washington. A registered patent attorney, Brian handles high-stakes, high-risk litigation involving clients’ most important assets, including their technologies, secrets, brands, creative work product, and business deals. He advises clients about the full range of IP protections and helps them monetize their technology assets through commercial negotiations and agreements. In addition to patent infringement, ownership, and false marking matters, Brian handles all forms of IP conflicts (including those related to copyrights, trademarks, trade secrets, advertising, and licensing). Apart from intellectual property, Brian has extensive experience with complex commercial litigation involving contract disputes, unfair competition, and corporate espionage. His practice includes the preparation of patent/technology opinions and commercial agreements tailored to safeguard a wide range of business interests and legal rights. His areas of technical and industry experience include the mechanical, chemical, electrical, biomedical, computer science, brand management, and industrial engineering arts. He has represented local and international clients ranging from small, privately held companies to large, global corporations. Before joining Stoel Rives, Brian was a partner at Dorsey & Whitney LLP, an associate at Seed and Berry LLP and Bogle & Gates PLLC, and a judicial clerk to the Honorable Wilkes C. Robinson of the U.S. Court of Federal Claims.

Jonathan Barnard is an associate in Stoel Rives’ Technology & Intellectual Property group. As a registered patent attorney, he provides U.S. and international patent-related services for clients ranging from emerging start-ups to multinational companies. Jonathan concentrates his practice on developing patent-filing strategies and portfolio-management programs, and preparing and prosecuting patent applications, as well as providing post-grant analysis. With a background in applied mathematics and physics, Jonathan has advised companies in the computer software, cloud computing, mobile applications, telecommunication, and electrochemical areas, among others. He has also represented clients that manufacture a range of technologies such as virtualized software systems; electronics; wireless communication systems; artificial intelligence; audio engineering systems; rain and stormwater management technologies; augmented, virtual, and mixed reality (AR/VR/MR) applications; and light detection and ranging (LiDAR) systems. Jonathan has also counseled clients in patentability, patent validity, patent infringement, due diligence and freedom to operate, product clearance, intellectual property (IP) litigation risk-mitigation strategies, IP licensing, standards-essential patent licensing, privacy and data security, open sourcing, and technology transactions. Before joining Stoel Rives, Jonathan was an associate with Dorsey & Whitney LLP (2019–2022), and both an associate and summer associate with Shook, Hardy & Bacon LLP (2016–2019). While in law school he was a judicial extern for the Honorable Justice Debra L. Stephens of the Washington State Supreme Court, as well as a law clerk in the legal department of a large, Seattle-area technology company.

Nathan Brunette is a partner in the Technology and Intellectual Property practice group. He focuses his practice on patent and intellectual property litigation as well as complex business disputes. He has represented clients in state and federal courts, private arbitration, and Uniform Domain Name Dispute Resolution Policy proceedings. His experience includes litigating patent, trademark, trade dress, licensing, cybersquatting, trade secret, civil antitrust, and commercial matters. In addition, he counsels clients about the protection, enforcement, and monetization of technology and intellectual property assets in the context of business opportunities and transactions. Prior to joining Stoel Rives, Nathan clerked for the Honorable Timothy Dyk of the U.S. Court of Appeals for the Federal Circuit and for the Honorable Deborah Chasanow of the U.S. District Court for the District of Maryland.
