Matthew Sked will provide insight into the USPTO guidance for patent practitioners on the use of AI-based tools in practice before the USPTO. His discussion will cover the AI/ET policy working group, some background on the impact of AI and developments in the legal field, an overview of the USPTO guidance on the use of AI-based tools, existing rules and policies for practicing before the USPTO, and application of the existing rules to the use of AI. Immediately following, a panel will discuss various topics related to Generative AI (GAI) based on guidance from the ABA Model Rules of Professional Conduct on AI. Topics will include competency and the use of GAI tools, confidentiality concerns, and communications with clients.
