Topic: Patent Portfolio Development and Artificial Intelligence: A Detailed Discussion and Practical Tips In View of Updated Guidance from the US Patent and Trademark Office

In July 2024, the USPTO published two new documents addressing patent subject matter eligibility, especially as applied to Artificial Intelligence (AI)-based innovations. These publications represent the first update to the analytical framework for patent subject matter eligibility by the USPTO in nearly five years. Our lunch discussion will include some brief background on historical aspects of patent subject matter eligibility and the USPTO’s existing analytical framework and a detailed discussion of the recent publications. Additionally, our discussion will focus on how the additional guidance can assist IP practitioners in identifying and prioritizing AI-based inventions, as well as drafting AI claims, amendments and arguments during prosecution.
